These Terms and Conditions ("Terms") govern your access to and use of the Go Dumpster Rental platform, including the website, checkout flows, customer portal, partner/provider interfaces, related mobile applications, and connected APIs (collectively, the "Platform").
By using the Platform, creating an order, or submitting information through the Platform, you agree to be bound by these Terms.
1. Service Scope and Role
1.1 Platform and services. Go Dumpster Rental ("GDR," "we," "us," "our") provides an online dumpster-rental marketplace and operations platform that enables users to request rental services, schedule service events, and make payments.
1.2 Intermediary and operator model. Depending on location and operational assignment, services may be fulfilled by GDR directly or by vetted third-party provider partners. Third-party providers are independent contractors and are not your employees or agents.
1.3 Service area limits. Service is offered only in supported U.S. areas and is subject to state and ZIP availability checks. Coverage messages and maps are informational and do not guarantee service at a specific address.
1.4 No guaranteed availability. Delivery, pickup, swap, extension, and rescheduling requests are subject to inventory, routing, weather, staffing, local law, and site safety conditions.
2. Eligibility and Authority
2.1 You must be at least 18 years old to place an order, create an account, or submit payment.
2.2 You represent that you have legal authority to enter into these Terms and to authorize all requested services at the service location.
2.3 You agree to provide current, complete, and accurate contact, payment, and site information and to promptly update it if it changes.
3. Accounts, OTP Login, and Security
3.1 The Platform supports guest checkout and customer account access, including phone/email OTP verification and password-based flows where enabled.
3.2 You are responsible for maintaining the confidentiality of verification codes, login credentials, and device access.
3.3 You must notify GDR immediately of suspected unauthorized account activity.
3.4 We may suspend or restrict access for suspected fraud, abuse, security risk, policy violations, or legal non-compliance.
4. Orders and Order States
4.1 Order creation. Orders may be created through fast checkout, checkout pages, customer portal, or authorized admin/staff actions.
4.2 Draft vs. payable status. Orders may begin in draft/pending-payment states and are not confirmed for operations until payment or approved payment arrangement is recorded.
4.3 Operational lifecycle. Orders move through operational statuses (including scheduling, delivered/active, pickup, completed, canceled) and financial statuses (including paid, partially paid, refunded, voided) separately.
4.4 Customer change requests. Extension, early pickup, reschedule, swap, cancellation, and reorder features are request-driven and may be approved, denied, delayed, or repriced.
4.5 Draft deletion. Draft orders awaiting payment may be eligible for customer-initiated soft deletion. Soft-deleted records remain in internal systems for audit, legal, and operational purposes.
4.6 Receipts and records. Digital receipts and account history are provided for convenience and may be corrected if errors are identified.
5. Pricing, Taxes, and Fees
5.1 Quoted pricing. Quoted totals are based on order details submitted at checkout and current pricing configuration for the service state/area.
5.2 Taxes and government charges. Applicable sales/use taxes, municipal fees, landfill/transfer station charges, and similar governmental or regulatory charges may apply.
5.3 Additional charges may apply. You may incur additional fees including, without limitation:
- overage/overweight fees,
- extra rental day fees,
- prohibited material handling or contamination fees,
- dry-run/trip fees (failed delivery or pickup due to access/site conditions),
- relocation or repositioning fees,
- after-hours or expedited service fees,
- permit-related costs and citations,
- disposal surcharges for special debris categories.
5.4 Price corrections. We may correct pricing, tax, math, or system errors before or after order submission and will notify you of material changes when required.
6. Payment Terms
6.1 Stripe processing. Online card payments are processed by Stripe. By paying through the Platform, you authorize payment processing through Stripe and related card-network rails.
6.2 Offline payments. Admin-authorized offline payment entries (for example, cash/check/Zelle/other methods) may be recorded and applied against account balances.
6.3 Authorization. You authorize GDR to charge approved amounts associated with your order, including approved adjustments, additional service fees, and lawful post-service balances.
6.4 Refunds. Refund eligibility depends on order stage, payment status, and service performance. Refunds may be full or partial. Processing times depend on Stripe, issuing bank, and payment method.
6.5 Voids. Certain unpaid or failed transactions may be voided instead of refunded when permitted by payment network rules.
6.6 Overpayments. Verified overpayments may be applied as account credit or refunded to the original payment method where feasible.
6.7 Chargebacks and disputes. You agree to contact GDR support before initiating a payment dispute. Fraudulent or abusive chargebacks may result in account suspension, collections activity, and recovery of dispute-related costs to the extent permitted by law.
7. Delivery, Pickup, and Site Conditions
7.1 Access requirements. You must provide safe and legal access for service vehicles, including sufficient clearance, stable load-bearing surface, and lawful placement location.
7.2 Site preparation. You are responsible for ensuring the service site is ready at scheduled times, including gate/entry access, obstruction removal, and any homeowner/HOA permissions.
7.3 Permits and approvals. You are solely responsible for obtaining and maintaining all required permits, street occupancy permissions, and local approvals.
7.4 Risk of delay or non-completion. If access or safety conditions are not met, service may be delayed, rescheduled, or canceled and additional fees may apply.
7.5 Property impact. Heavy equipment and containers can affect pavement, concrete, landscaping, curbs, and subsurface conditions. To the maximum extent allowed by law, you assume risks inherent to requested placement and site conditions unless caused by gross negligence or willful misconduct.
8. Prohibited Materials and Legal Disposal
8.1 You must not place prohibited, hazardous, regulated, explosive, infectious, radioactive, or illegal materials in containers.
8.2 Prohibited materials include, by way of example: hazardous chemicals, asbestos-containing waste, medical/biohazard waste, flammables, pressurized cylinders, and other restricted materials under local/state/federal law.
8.3 You represent and warrant that all disposed material is lawfully generated, owned/controlled by you, and compliant with disposal laws.
8.4 We may refuse service, quarantine loads, reclassify debris, assess remediation fees, report unlawful activity, and cooperate with authorities where required.
9. Customer Responsibilities and Indemnification
9.1 You are responsible for all activity under your account and all services requested using your contact information, subject to applicable law.
9.2 You agree to defend, indemnify, and hold harmless GDR, its affiliates, officers, employees, provider partners, and service providers from claims, damages, losses, liabilities, penalties, and expenses (including reasonable attorneys' fees) arising from:
- your breach of these Terms,
- unsafe or unauthorized site conditions,
- prohibited or unlawful disposal,
- your violation of law or third-party rights.
10. No Warranty; Limitation of Liability
10.1 No warranty. The Platform and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
10.2 Liability cap. To the maximum extent permitted by law, GDR's aggregate liability for any claim arising out of or related to your use of the Platform or services will not exceed the total amount you paid to GDR for the specific order giving rise to the claim during the 12 months before the claim.
10.3 Excluded damages. To the maximum extent permitted by law, GDR is not liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages.
10.4 Some jurisdictions do not allow certain liability limitations; in those jurisdictions, limitations apply only to the extent legally permitted.
11. Force Majeure
GDR is not liable for failure or delay in performance caused by events beyond reasonable control, including severe weather, natural disasters, labor disputes, governmental actions, roadway restrictions, landfill closures, telecommunications outages, payment network outages, cyber incidents, or other force majeure events.
12. Communications; SMS and Email Consent
12.1 By using the Platform and providing contact information, you consent to receive transactional calls, SMS, and emails related to orders, account security, OTP verification, scheduling, support, and billing.
12.2 Message and data rates may apply based on your carrier plan.
12.3 Transactional and legally required communications may be sent even if you opt out of promotional messaging.
12.4 If promotional messaging is offered, you may opt out as described in the message or by contacting support.
13. Admin and Operational Authority
To protect platform integrity, legal compliance, and customer safety, GDR may:
- cancel, hold, or reject orders,
- correct pricing/configuration errors,
- reassign provider partners,
- require additional verification,
- decline unsafe or non-compliant service requests,
- modify schedules when operationally necessary.
14. Intellectual Property and Platform Use Restrictions
14.1 The Platform, software, workflows, branding, content, and data models are owned by GDR or its licensors and protected by law.
14.2 You may not copy, scrape, crawl, frame, reverse engineer, decompile, disassemble, or create derivative works from the Platform except as expressly permitted by law.
14.3 You may not use bots, automated extraction, or abusive traffic patterns that interfere with platform operation.
15. Privacy
Your use of the Platform is also governed by the Go Dumpster Rental Privacy Policy, which describes data collection, use, sharing, retention, and rights.
16. Governing Law; Dispute Resolution; Arbitration
16.1 Informal resolution first. Before filing arbitration or court claims, you and GDR agree to attempt informal resolution for at least 30 days by sending written notice to [email protected].
16.2 Binding arbitration. Except where prohibited by law, any dispute arising out of or relating to these Terms, the Platform, or services will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under applicable consumer rules.
16.3 Federal Arbitration Act. Arbitration will be governed by the Federal Arbitration Act. If arbitration is unavailable for a specific claim, that claim may be brought in a court of competent jurisdiction in the United States.
16.4 Class action waiver. You and GDR agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private-attorney-general proceeding, to the extent permitted by law.
16.5 Jury waiver. To the extent permitted by law, each party waives any right to a jury trial for claims not subject to arbitration.
16.6 Small claims and injunctive relief. Either party may pursue qualifying individual claims in small-claims court. Either party may seek injunctive or equitable relief for intellectual property misuse or unauthorized platform access.
17. Changes to These Terms
We may update these Terms from time to time. Updated versions become effective on posting unless a later date is stated. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
18. Termination
We may suspend or terminate access to all or part of the Platform at any time for legal, security, abuse-prevention, or policy-enforcement reasons. Sections that by nature should survive termination (including payment obligations, indemnity, liability limitations, dispute resolution, and IP protections) survive termination.
